1. ACCEPTANCE OF TERMS

Welcome to Pick Your Gift. These Terms of Use constitute a legally binding agreement made between you and Caroline ("we," "us," or "our"), concerning your access to and use of the Pick Your Gift website and mobile application (collectively, the "Platform").

By accessing, browsing, or using the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use our Platform.

We reserve the right to modify these Terms at any time. Your continued use of the Platform following the posting of revised Terms means that you accept and agree to the changes.

2. ELIGIBILITY

You must be at least 13 years old to use the Platform. By using the Platform, you represent and warrant that you meet the eligibility requirements and have the right, authority, and capacity to enter into these Terms.

3. ACCOUNT REGISTRATION

To access certain features of the Platform, you will need to register for an account. When registering, you agree to provide accurate, current, and complete information and to update this information to maintain its accuracy.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

You retain all rights to the content you submit, post, or display on or through the Platform ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with providing the Platform.

You represent and warrant that you own or have the necessary rights to the User Content you submit and that such content does not violate the rights of any third party.

5. PROHIBITED CONDUCT

You agree not to engage in any of the following prohibited activities:

  • Using the Platform for any illegal purpose
  • Uploading or transmitting viruses, malware, or other malicious code
  • Attempting to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Platform
  • Impersonating another person or entity
  • Collecting or harvesting any personally identifiable information from the Platform
  • Using the Platform in a manner that could disable, overburden, damage, or impair the site
  • Posting content that is defamatory, obscene, threatening, or otherwise objectionable

6. INTELLECTUAL PROPERTY RIGHTS

The Platform and its original content, features, and functionality are owned by Caroline and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7. THIRD-PARTY LINKS AND CONTENT

The Platform may contain links to third-party websites or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

8. TERMINATION

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason, including, without limitation, if you breach these Terms.

9. DISCLAIMER OF WARRANTIES

The Platform is provided on an "AS IS" and "AS AVAILABLE" basis. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. LIMITATION OF LIABILITY

In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Platform.

11. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable attorney's fees and costs, arising out of or in any way connected with your access to or use of the Platform or your violation of these Terms.

12. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Paris, France.

13. SEVERABILITY

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

14. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Platform and supersede all prior agreements and understandings.
